GenuineWeb reserves the right to change this Policy any time, so
please, check this page at least once a month or when in doubt.
GenuineWeb strives to provide the best possible service to all our
customers, but we will not tolerate any unlawful activity or abuse on
our servers. We respect freedom of speech and expression unless it is
harmful to others. These brief guidelines are imposed to protect you,
other GenuineWeb customers and us against such harm.
Our Commitment To Privacy
Your privacy is important to us. To better
protect your privacy we provide this notice explaining our online
information practices and the choices you can make about the way your
information is collected and used. To make this notice easy to find,
we make it available on our homepage and at every point where
personally identifiable information may be requested.
The Information We Collect:
This notice applies to all information
collected or submitted on the GenuineWeb
website. On some pages, you can order services, make requests, and
register to receive materials. The types of personal information
collected at these pages are:
The Way We Use Information:
We use the information you provide about
yourself when placing an order only to complete that order. We do not
share this information with outside parties except to the extent
necessary to complete that order. We use the information you provide
about someone else when placing an order only to ship the product and
to confirm delivery. We do not share this information with outside
parties except to the extent necessary to complete that order. We use
return email addresses to answer the email we receive. Such addresses
are not used for any other purpose and are not shared with outside
parties. Information you submit on our website will not be used for
this purpose unless you fill out the registration form. We use
non-identifying and aggregate information to better design our website
and to share with advertisers. For example, we may tell an advertiser
that X number of individuals visited a certain area on our website, or
that Y number of men and Z number of women filled out our registration
form, but we would not disclose anything that could be used to
identify those individuals. Finally, we never use or share the
personally identifiable information provided to us online in ways
unrelated to the ones described above without also providing you an
opportunity to opt-out or otherwise prohibit such unrelated uses.
Our Commitment To Data Security
To prevent unauthorized access, maintain
data accuracy, and ensure the correct use of information, we have put
in place appropriate physical, electronic, and managerial procedures
to safeguard and secure the information we collect online.
Our Commitment To Children's Privacy:
Protecting the privacy of the very young
is especially important. For that reason, we never collect or maintain
information at our website from those we actually know are under 13,
and no part of our website is structured to attract anyone under 13.
Payment Policies, Fees,
Refunds and Terms of Agreement -
Hosting - Full payment is required before any hosting service is
rendered, which includes renewals. Prepayment is due each 30 or 90
days (whatever billing option you chose) following the date the
account was established. Billing will continue until you cancel your
hosting account. You may cancel at anytime. As a policy, we do offer
credits or refunds for hosting in your first 30 days from account
creation.
This only applies to cancellation by the client. If cancellation is
done by GenuineWeb due to restrictions violation, there will be no
refund. GenuineWeb will only allow for the refund if cancellation is
not the fault of the client, as determined by GenuineWeb. All monetary
transactions are in $US dollars. Additional features can be added at
any time. Monthly/Quarterly feature prices are not prorated.
GenuineWeb reserves the right to change prices at any time.
Accounts that are 60 days past due with
the billing department will be temporarily suspended until payment has
been received.
Any Design work - 50% is required to begin. Balance is to be paid upon
completion. Deposits are non-refundable.
Account Cancellation -
You may cancel at anytime. To cancel your account, please email
cancel@genuineweb.com with the email address on file with us.
Indemnification Policy -
You agree to use all GenuineWeb’s services and facilities at your own
risk. GenuineWeb specifically disclaims all warranties of
merchantability and fitness for a particular purpose. In no event
shall GenuineWeb be liable for any loss, or loss of data, or other
commercial damage, including but not limited to special, incidental,
consequential or other damages. Customer agrees that it shall defend,
indemnify, save and hold GenuineWeb harmless from any and all demands,
liabilities, losses, costs and claims, including reasonable attorney’s
fees asserted against GenuineWeb, its agents, its customers, officers
and employees, that may arise or result from any service provided or
performed or agreed to be performed or any product sold by customer,
it’s agents, employees or assigns. Customer agrees to defend,
indemnify and hold harmless GenuineWeb against liabilities arising out
of:
-Any injury to person or property caused by any products sold or
otherwise distributed in connection with GenuineWeb’s server.
-Any material supplied by customer infringing or allegedly infringing
on the proprietary rights of a third party
-Copyright infringement
-any defective products sold to customer from GenuineWeb’s server.
GenuineWeb shall be the sole judge of what violates this Policy.
SPAM Policy:
GenuineWeb is committed to a zero-tolerance, anti-Spamming policy.
Under this policy, we prohibit Spam, or any unsolicited commercial
email, from being sent either: Over the GenuineWeb network, by
customers or any other users of the GenuineWeb network (including
customers' customers); AND/OR over ANY network— if the message sent
advertises or mentions a site hosted on the GenuineWeb server. We
react very quickly and seriously to violations, and we further reserve
the right to terminate the services, without prior notice, of any
customer disregarding this policy. Sending unsolicited commercial
email (a.k.a. "spam"), cross-posting messages to a large number of
Usenet groups, posting obscene or threatening messages while using or
referring to an GenuineWeb email address or web site URL is
prohibited. The use of GenuineWeb’s servers as a mail drop for
responses to activities described above is also prohibited. Accounts
cancelled due to spam are subject to a "clean up" fee of $100.
Content Policy:
All services provided by GenuineWeb may be used for lawful purposes
only. Transmission, storage, or presentation of any information, data
or material in violation of any United States Federal, State or City
law is prohibited. This includes, but is not limited to: copyrighted
material, trademark, intellectual property, material we judge to be
threatening or obscene, or material protected by trade secret and
other statute without proper authorization. The subscriber agrees to
indemnify and hold harmless GenuineWeb from any claims resulting from
the use of the service which damages the subscriber or any other
party. Pornography and sex-related merchandising is prohibited on all
GenuineWeb’s servers. This includes sites that may infer sexual
content, or links to adult content elsewhere. GenuineWeb will be the
sole arbiter in determining violations of this provision. Also
prohibited are sites that promote any illegal activity or present
content that may be damaging to GenuineWeb’s servers or any other
server on the internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
-Pirated software
-Hacker programs or archives
-Warez sites
GenuineWeb does not host sites of its competitors or web pages
promoting sites of its competitors. Any illegal activity, including
adult content, links to adult content web sites, spamming or hacking
will result in your site being shut down and all your files deleted
without warning. GenuineWeb will be the sole arbiter as to what
constitutes a violation of this provision.
SSH Policy -
GenuineWeb enforces a strict "No SSH" policy. Any domain that uses a
script which can be used to elevate privileges or enable SSH services
will be instantly suspended.
CGI Scripts Policy -
Each account comes with its own cgi-bin. You are free to use any CGI
scripts you wish, however we reserve the right to disable any CGI
script that effects normal server operation or service to other
GenuineWeb customers. You will be notified in 24 hours about offending
cgi script. No chat room or similar scripts allowed. GenuineWeb is not
responsible for scripts that you use in your hosting. It is not our
responsibility to ensure your scripts function. Please don't expect
our support techs to troubleshoot aspects of your scripts or third
party scripts that you use on your sites hosted on our servers.
Chat Policy:
GenuineWeb does not allow chat rooms. You can however use the chat
room software that comes pre-installed in your Control panel.
Backups -
Full backups are made daily. No guarantees are made of any kind,
either expressed or implied, as to the integrity of these backups.
Backups are made for server restoration purposes only. It is the
clients' responsibility to maintain local copies of their web content
any information. The Backup Manager is included in each hosting plan
and you can use this tool to backup your files. If loss of data occurs
due to an error of GenuineWeb, we will attempt to recover the date for
no charge to the client. If data loss occurs due to negligence of
client in securing their account or by an action of the client,
GenuineWeb will attempt to recover the data from the most recent
archive for a $10.00 fee.
